Nullity of marriage, on the other hand, means that the marriage is held null and void, that is the marriage is legally non-existent and a valid marriage did not take place at all. While divorce relates to sustainability of marriage, nullity refers to validity of the same.

A legal separation is when a married couple decides to live separately but remains legally married. A divorce, however, is the legal dissolution of marriage — meaning the court terminates the marriage's legal bond, determines child custody and support, and divides assets and liabilities.

Nullity and Divorce are quite different. Divorce is the dissolving of a valid marriage following a period of at least 12 months separation of the parties. A Nullity is an Order of the Family Court that the marriage never existed.

Nullity: While a Dissolution action is an action to dissolve a valid marriage or domestic partnership, a Nullity action is a judicial determination that the marriage or domestic partnership is void or voidable and hence not a valid marriage.

In a Declaration of Nullity of Marriage, the marriage that is sought to be declared void ab initio or void from the beginning. Whereas in an Annulment, the marriage is considered voidable, or the marriage is valid but is susceptible of being voided pursuant to the grounds provided under the law.
