UNDER THE FAIR LAbOR STANDARDS AcT Youths 14 and 15 years old may work outside school hours in various non-manufacturing, non-mining, non-hazardous jobs under the following conditions: No more than • 3 hours on a school day or 18 hours in a school week; • 8 hours on a non-school day or 40 hours in a non-school week.

An Eligibility to Work form is required for each 14 or 15 year old minor employed. These forms can be obtained by the minor from their school. The Eligibility to Work form must be kept in the employee's file.

Work permits can be obtained from the local board of education or the minor's school. Several items are required of the minor who wishes to get a work permit, including proof of age, a statement from a parent, and a statement from his or her prospective employer.

Generally speaking, the Fair Labor Standards Act (FLSA) sets the minimum age for employment (14 years for non-agricultural jobs), restricts the hours youth under the age of 16 may work, and prohibits youth under the age of 18 from being employed in hazardous occupations.

Employers hiring children 17 or younger must obtain a Child Labor Certificate from the Alabama Department of Labor for each location where children under 18 years old will be employed.
