The standard for granting Protective Orders that is “if the court finds that the petitioner has proven the allegation that the petitioner is or has been, within a reasonable period of time, subjected to an act of violence, force, or threat by a preponderance of the evidence.” Va. Code 19.2-152.9.

A TPO in Georgia is a civil court order. So, if a party willfully or intentionally violates any terms of the TPO, that party could be found in contempt. If that party is found in contempt after a hearing, that party could be subject to jail time and/or fine.

A judge can grant a PO that lasts for up to two years. In order to obtain this PO, you must attend the final Protective Order hearing, which is scheduled at the time of your PPO hearing.

One way to fight a TPO in Georgia is to challenge the petition for TPO procedurally. Pursuant to the Georgia TPO statute, there are specific procedural requirements that must be followed. If certain procedural requirements are not satisfied, you may raise this issue with the court to challenge the TPO.

Any person who is found to be in violation of an order can face jail time and additional felony criminal charges, such as aggravated stalking.

Violating a restraining order in Georgia can come with serious repercussions including being charged with aggravated stalking or going to jail. Violating a protective order can come with a penalty of up to 10 years in prison and a fine up to $10,000.

All EPOs issued on form EPO-001 expire on whichever occurs first: Close of court business on the fifth court day starting the day after the EPO is issued. Seven calendar days starting the day after the EPO is issued.
