If your spouse doesn't file an answer in court within 30 days after they were served, your divorce is uncontested. Marital misconduct refers to conduct that is alleged to have caused the erosion of a marriage. In some states the spouse found guilty of marital misconduct will be adversely affected during property division, distribution of spousal support, or awarding attorney's fees.

Once your paperwork is filed and you execute proper service, your spouse will have thirty days to file a response. If they do not then you and your lawyer can file a Motion for Default Judgment with the court.
