A donor, with the mental capacity to act, can revoke a lasting power of attorney (LPA) by sending a revocation notice to the attorney(s) and the Office of the Public Guardian (OPG).

Prepare a written statement of revocation with the name of the agent and the date you made the power of attorney you wish to revoke. Sign the revocation before a notary. You can hand-deliver a copy to your agent or send it by certified mail so that you can prove that it was received.

The principal can revoke a POA when there is gross mismanagement on the agent's part, the agent breaches the contract terms, or acts beyond his/her scope of powers. In such cases, even an irrevocable POA can be revoked by issuing a revocation notice.

The Principal may revoke Power of Attorney if he found an agent in some fraud or misconducting the business and legal activities. The competence of contracting agreement is necessary for both of them. And if the documents which bind agent and principal are not met then it can be challenged in court.

You can end your lasting power of attorney ( LPA ) yourself - if you have mental capacity to make that decision. You need to send the Office of the Public Guardian ( OPG ) both: the original LPA. a written statement called a 'deed of revocation'

You can revoke a power of attorney by giving written notice to your agent and to some one in charge at any place where you expect the agent would try to use the power. For example, you would want to give written notice to your banks.

It also says the only way to revoke the POA is by a written revocation that is also recorded like a conveyance, or a memo of revocation is made on the margin of the original record. (Most offices do not accept marginal notations.)

All a principal needs to do to revoke a power of attorney is send a letter to the agent notifying the agent that his or her appointment has been revoked. From the moment the agent receives a revocation letter, he or she can no longer act under the power of attorney.

You can revoke (cancel) your power of attorney document at any time with a written notice to your agent. A sample “Notice of Revocation” is included in this packet.

Texas's statutory form of durable power of attorney is found in Section 752.051 of the Texas Estates Code. It is a financial durable power of attorney - this means that it only allows the agent to handle financial matters. It does not permit the agent to make decisions about the principal's health care.
