Texas courts have held that a landlord may not enter your home unless you allow the entry or the lease gives the landlord specific reasons to enter. Study your lease to determine when the landlord may enter your home.

The Tenant Protection Act of 2019 (AB 1482) restricts rent increases in any 12-month period to no more than 5% plus the percentage change in the cost of living (CPI), or 10%, whichever is lower. For increases that take effect on or after Aug. 1, 2022, due to inflation, all the applicable CPIs are 5% or greater.

There is not a statewide law that places limits on how much a landlord can increase the rent when a lease is renewed. In fact, Texas law only allows cities to establish local rent control ordinances in certain cases. A state of disaster has to have been declared and the city must find that a housing emergency exists.

You can submit a complaint online, or you can call their office at (512) 463-2642 or toll-free (Texas only) at (888) 452-4778.

This year, the rules say rents can be increased by last September's Consumer Price Index (CPI), plus an extra 1%. The CPI is a common measure of inflation and in September 2021 was 3.1%. This means that most rents will increase by 4.1% from April 2022.

The Lone Star State's capital saw a 35% increase in average rent prices between January 2021 and January 2022, the report stated.

This means your landlord cannot evict you without proper cause (most commonly nonpayment of rent) or otherwise disturb your right to live in peace and quiet. Your landlord must also protect you from any wrongful actions taken by other tenants. The right to health and safety in your home.

Unfortunately, Texas has no law control or rent stabilization laws like in other states. Hence the state fails to regulate or intervene on how much a landlord can raise the rent in Texas. According to the Apartment List National Rent Report rents in key cities in Texas have gone up over the past 6 and 12 months.
