How much notice must my landlord give? A landlord must give 24 hours' written notice before they can enter a property - assuming they are given permission by the tenant - and can only arrange to visit at a 'reasonable' time of the day; so ideally not late at night or early in the morning.

A 24-hour notice is probably “reasonable” in most situations. The notice does not have to be in writing. If a landlord enters your home without notice while you are out, they have to leave a note in a place where you can see it.

Texas courts have held that a landlord may not enter your home unless you allow the entry or the lease gives the landlord specific reasons to enter. Study your lease to determine when the landlord may enter your home.

24-hour notice required The landlord must give you 24-hour advance written notice before entering. The notice should state a specific time of entry, which must be during normal business hours.

This means your landlord cannot evict you without proper cause (most commonly nonpayment of rent) or otherwise disturb your right to live in peace and quiet. Your landlord must also protect you from any wrongful actions taken by other tenants. The right to health and safety in your home.

Landlords and their agents or contractors should only carry out work or inspect your home at reasonable times. You're entitled to: at least 24 hours' written notice of an inspection. reasonable notice if someone needs access to your home to carry out repairs.

Can a tenant refuse entry to a landlord or letting agent? Yes, they can. In 99% of cases a tenant refusing entry to a landlord will usually boil down to convenience, or lack thereof. Simply adjusting the time and date will be enough to gain access to the property.

You are paying rent to the landlord for exclusive use as the property as your home and as such you have the right to decide who enters it and when. If a landlord enters your home without permission they are, technically, trespassing, unless they have a court order to allow them otherwise.

Texas courts have held that a landlord may not enter your home unless you allow the entry or the lease gives the landlord specific reasons to enter.

Many tenants believe the landlord is required to give 24 hours notice before entering the rental unit but this is not true. As with many questions previously addressed in this brochure, the landlord is only obligated to give advance notice if required under the lease.
