In order to reduce the risk to WA Landowners from being the subject of improper dealings on their property, a caveat (Improper Dealings) can be lodged with Landgate. The caveat, once lodged, will stop the registration of any instruments or documents that would ordinarily need to be signed by the owner.

This section states: “(1) A caveatee may at any time apply to the Supreme Court for an order that a caveat be removed. (2) The Supreme Court may make the order whether or not the caveator has been served with the application, and may make the order on the terms it considers appropriate.”

By Withdrawal. A caveat may be withdrawn by lodgement of a Withdrawal of Caveat form. Landgate introduced the ability to lodge a Withdrawal of Caveat electronically in May 2015. The removal of a caveat under this process is made by the caveator and signed by the caveator, unless being lodged electronically.
