The Infraction Deferral Program is offered by the Allen County Prosecutor's Office for infraction cases. If you comply with the conditions of the program, the case is dismissed and notice of the violation is not sent to the Bureau of Motor Vehicles (BMV). Not all infractions are eligible for the program.

Deferral Program Process If you wish to enter the Deferral program, you will sign an Infraction Deferral Agreement and pay a fee of $192.50. You do this instead of paying the ticket (i.e. do not pay the ticket and then request the Deferral agreement).

To apply for the Traffic Infraction Deferral Program, you must submit the application within 15 calendar days of the violation date, or you must have already received a court date. Your request for an online deferral must be received no less than 4 business days prior to your court hearing.

The only way to dismiss an Indiana ticket is to fight it in court. Here's how it works: You have 60 days from the date of your traffic violation to let the court know that you are pleading not guilty.

You're first option is to fight the ticket. In Indiana this is the only way to have your ticket fully dismissed. To do so you will have to officially plead not guilty and contest the ticket.

The Safe Driver Deferral Program allows individuals charged with a traffic infraction an opportunity to keep the infraction from appearing on their driving record by paying a one-time fee and agreeing to not commit any further traffic violations for six months.
