Juvenile dependency court hears cases involving children who have allegedly been abused, neglected, or inadequately cared for. The laws governing dependency court can be found within the California Welfare and Institutions Code (WIC § 300 et seq.).

If parents can't or won't take care of their child properly, the juvenile court may step in and the child may become “dependent” on the court for safeguarding. When this happens, the child may have to live with relatives or another family for awhile. This temporary family is called a foster care family.

The first stage of juvenile pretrial procedures is: intake.

If a child is adjudicated 'dependent' in the hearing, meaning the child is without proper care, it allows the court to order services and programs for the child and family that include the following: ● Drug, alcohol, or mental health evaluation for child or parents.

The first hearing is called the Detention Hearing. At this hearing: The Court gives the parents a notice about what is going on (the “proceedings”). The parents get a copy of the petition and any other papers for the case. The Court tells the parents what can happen in a dependency case.

Courts in the juvenile justice system are focused on rehabilitating juveniles rather than punishing them like adults. The system has a lot of flexibility because its main goal is to correct juvenile offenders and not necessarily to punish them.

The second part is called a Disposition Hearing, at this second hearing, the Court reviews the social study and may order probation supervision, placement out of the home or commitment of the youth to the Texas Youth Commission.

ing to the Texas Family Code Section 54.01(a), a juvenile detention hearing must be held “promptly” – within two business days – of a child being taken into custody. If the child is detained on a Friday or Saturday, then the hearing will be held on the first business day after the child is taken into custody.

Juvenile “delinquency” and juvenile “dependency” are two separate court systems in California. The juvenile delinquency system is concerned with minors charged with crimes. The juvenile dependency system focuses on minors who have been abused, abandoned or neglected.

What does the Dependency Court do? The law says that Dependency Court has to protect the minors in the juvenile court. The court tries to keep minors with their families and make the families stronger. The court will take a minor from the parents if it has to for the child's well being and safety.
