The state imposes a governmental gross receipts tax of 5.00% on the receipts of New Mexico state and local governments. The exceptions are the gross receipts of public school districts and entities licensed by the Department of Health that are principally engaged in providing health care.

Electronic reporting Effective July 1, 2006, all reports containing more than 25 properties must be submitted electronically. For more information about electronic reporting, please call (505)827-0668 or visit or email unclaimed.property@tax.nm.gov.

The New Mexico Uniform Unclaimed Property Act requires a holder of property that is presumed abandoned to send written notice to the owner at the last known address in 60 days or less, but not more than 120 days before filing the report.

Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time.

In New Mexico abandonment means the absence of the tenant from the premises, without notice to the landlord, for more than seven continuous days, and only after rent is delinquent. When abandonment is confirmed the rental agreement may be terminated, and the process of handling any personal property left behind begins.

Unclaimed property dormancy is a period of time during which there is no activity from the unclaimed property owner. The unclaimed property dormancy varies by property type, but is pretty uniform across the states for that type of property.
