INSTRUCTIONS ON FILING A MOTION FOR CONTEMPT Contempt of court is a ruling by the judge that a person is intentionally failing to follow a judge's order. A person who is cited for contempt may be punished by a fine or a jail sentence until he or she obeys the court order.

If a parent does not obey a support order, he or she may be found in contempt of court. A contempt action may be filed against the NCP who fails to make support payments or does not maintain the required medical insurance. NCPs found in contempt of court may be fined, sentenced to jail, or both.

If either party does not follow the court order, he or she is considered to be in contempt of court. These are intentional violations of a court order and are punishable by fines, attorney's fees and even jail time.

Penalties for Contempt of Court Under Georgia Law, a person who is found guilty of criminal contempt of court can be fined up to $500 and face up to 20 days of jail. But, if for example, a husband refuses to pay alimony to his ex-spouse, even though he has the ability to do so, they could be held confined indefinitely.

If a parent violates a Georgia court order regarding custody or visitation, the other parent can file a motion asking the court to enforce the order and hold the parent in contempt. The exact procedure will depend on which county you live in; many county courts have forms that you can fill out on your own.

The Motion must be EFiled. You can come into the Clerks office to use an EFile hub provided at no additional cost. PAYING THE FILING FEE: If the contempt is on Non-Payment of Child Support, Alimony or Medical expenses, the filing fee is waived.

The judge simply declares that the offender has been found in contempt. The judge then immediately adds the punishment, which usually is a fine, confinement for a day or two, or both. In rare cases, confinement can extend to several months, or until further Order of the Court – whenever that may be.

You will also need the divorce case number and date and a copy of the final decree and child support order as evidence attachments.
