Non-residents If you have any gross income from sources inside the state during the tax year, then you must file a tax return. If you don't have any income that is generated inside of Delaware and your spouse files a married separate return, then you do not have to file a Delaware tax return.

A Delaware Resident is an individual who is domiciled in Delaware for any part of the tax year or maintains an abode in Delaware and spends more than 183 days here. A Delaware Part-Year Resident is an individual that moves into or out of Delaware during the tax year.

Some of you have to pay federal income taxes on your Social Security benefits. This usually happens only if you have other substantial income in addition to your benefits (such as wages, self-employment, interest, dividends and other taxable income that must be reported on your tax return).

If additional tax is due, file Form 1027, Application for Automatic Extension of Time to File Delaware Individual Income Tax Return, by May 2, to request an extension to October 16.

Form 200-02 is an amended tax return form for part-time or non-residents who are filing a Delaware income tax return. Form 200-01 is the default income tax return form for Delaware residents.
