The problem with disclosing the existence of asbestos in a home is that unless you've actually tested for it you don't truly know if it's asbestos. If you have tested and the test was positive for asbestos, you are required to disclose this knowledge to any potential home buyer.

Colorado law requires that you disclose all misdemeanor and/or felony criminal convictions including those based on a plea of no contest and any deferred judgements or deferred sentences, except for misdemeanor traffic offenses and/or traffic infractions (DUI*,careless driving, speeding, etc.)

The seller has a legal responsibility to disclose latent defects if they know, or should have known, about them.

In Colorado, the seller's property disclosure responsibility also extends to the real estate professional. Colorado statute provides that a broker acting as a seller's agent must disclose to any prospective buyer all adverse material facts actually known by such broker.

As to the vacant land disclosure, a seller must disclose information regarding the use and access, water and sewer, environmental conditions, noxious weeds, and violations of law. Both forms contain warnings to the seller that the completion of the form has important legal consequences.

Although these disclosures are required by law and you should engage a real estate broker or attorney, the disclosures that cause lawsuits are the ones related to leaks and other water-related problems (i.e. mold, roof leaks, window leaks, flooding, etc.).

If you are selling a home, you are required to disclose only facts actually known to you. In other words, you are not required to disclose facts about the property that you "should have known," nor are you required to commission any inspections of your property in advance of filling out the form.

Many times additions, finishing unused spaces, and more do not get updated on the assessor's website. Since a property's square footage is a key component when listing a property for sale and in determining what to list a home for based on price per square foot, ensure the number is correct and up to date.
