What is the Penalty for Failing to Appear? Failing to appear is a hybrid offence that has a maximum penalty to 2 years in jail where the Crown Attorney proceeds by indictment and 6 months in jail when the Crown proceeds summarily.

If you ever failed to attend court for a criminal matter in Ontario, it is almost guaranteed that the court issued a bench warrant for your arrest. Most OCJ courts will issue a bench warrant if the accused does not show up for their first court appearance date or stops attending court after a few appearances.

Bench warrants, themselves, do not carry any jail time. Neither do arrest warrants. However, once the warrant is executed, the suspect or defendant is brought into custody. He or she will be held in jail until they can be brought in front of a judge.

What happens when you fail to appear in court in Brampton? Brampton falls under Ontario provincial law. If a defendant doesn't appear in court, your judge can issue a bench warrant, adjourning the hearing to a different day. The bench warrant could lead to the defendant being arrested.

This information is called “disclosure” and you must ask for it in order to get it. This request may have to be made in writing. Contact the court office shown on your ticket or summons as soon as possible to find out how to receive the disclosure materials for your case.

Part Three Offence – Summons to Appear Summons to appear in court are usually given for speeds over 50km/h or offences in Community Safety Zones, and stunt driving charges.

The trial period will depend on the type and complexity of the offence, the number of witnesses and whether the case is being heard before a judge or jury. While simple low priority cases typically take one to two days, more serious and complicated matters may take days, weeks or even months.

There are three different types of Provincial Offence notices: Part I - a ticket that is issued to an individual. Part II - a parking infraction (Note: These are not paid at our office. See Parking Enforcement at 1266 McDougall) Part III - a summons (including a court date)
