Form I-140, Immigrant Petition for Alien Workers, is a type of employment-based green card application that is sent to USCIS. Employment-based green cards are the physical cards that show someone's permanent residency status.

With standard processing it usually takes about 6-9 months for the I-140 immigrant petition to be processed once you file it. If you elect to do the optional premium processing, the application can be processed within 15 days.

USCIS processing time for an I-140 Petition is typically four to six months. However, for an additional filing fee, the USCIS will adjudicate the petition via “premium processing” (15 calendar days).

It can take anywhere from 10 months to over 2 years for U.S. Citizenship and Immigration Services (USCIS) to process Form I-140, depending on which service center is reviewing the petition.

For both EB-2 and EB-3, PERM labor certification is required, whose processing time takes about six-twelve months. The processing time for form-I-140 takes about six-nine months. This time period can be shortened up to a mere period of 15 days through premium processing.

USCIS will send you notification of a biometrics appointment and process your I-765 (work document) and/or I-131 (travel document). Afterward, you would be scheduled for an interview with a USCIS officer, and after a successful interview, your “green card” should be approved, printed and mailed.

Current processing time for I-140 petitions in the multinational executive and manager classification is a little more than a year. For a member of the professions with an advanced degree or exceptional ability seeking a National Interest Waiver, the processing time is even longer – roughly 16 to 19 months.

As of March 2023, an EB-1 visa takes between 8 to 23 months to process. The I-140 stage can be expedited to 15 days. After the EB1 petition is approved, check the Visa Bulletin to find out if your priority date (“PD”) is current.
