What Is the Purpose of This Form? The Form I-864 is legally required for many family-based immigrants and some employment-based immigrants to show that they have adequate means of financial support and that they are not likely to become a public charge.

The applicant must complete Form I-864W. You filed an I-360 Petition for Amerasian, Widow(er), or Special Immigrant and are a self-petitioning battered spouse or child. The applicant must complete Form I-864W.

To qualify, an I-864 joint sponsor must meet all of the following requirements: Be a U.S. citizen or green card holder. Be at least 18 years old. Reside in the United States or a U.S. territory but not in either spouse's household.

There is no filing fee to file Form I-864W with USCIS.

The person who signs the Affidavit of Support is also called the “sponsor.” The petitioner must complete Form I-864; however if the petitioner's income is insufficient, a joint-sponsor may agree to also complete an I-864 on the applicant's behalf.

I-864W, Request for Exemption for Intending Immigrant's Affidavit of Support. Use this form to establish that applicant is exempt from the Form I-864 requirements.

Who completes this form? The intending immigrant completes and signs this form in black ink. If the intending immigrant is younger than 14 years of age, the U.S. citizen parent may complete and sign the form. A guardian may sign the form for an individual who is under guardianship.

The petitioning sponsor must complete and submit a signed Form I-864 for the intending immigrant even if there will also be a joint sponsor.
