Who Must File. A partnership (including REMICs classified as partnerships) that engages in a trade or business in California or has income from a California source must file Form 565.

Every partnership that has income or loss derived from sources in the State of New Jersey, or has a New Jersey resident partner, must file Form NJ-1065. A partnership must file even if its principal place of business is outside the State of New Jersey. Form NJ-1065 is no longer solely an information return.

Resident partners should file the Income Tax Form NJ-1040 to report their share of partnership income. Nonresident partners should file Form NJ-1040NR to report their income and to claim the Share of Tax Paid on Your Behalf by Partnership.
