In December 2016, the state of Michigan adopted Public Act 394 of 2016 restricting the use of seclusion and restraint in schools.

Emergency seclusion must only be used in response to an ongoing emergency situation and not as a planned response for the convenience of school personnel, as discipline or punishment, or as a substitute for an appropriate educational program.

There are three types of restraints: physical, chemical and environmental.

Seclusion: Defined as the involuntary confinement of an individual alone in a room or area from which the individual is physically prevented from leaving.

“Seclusion” has been defined by the Michigan State Board of Education as the confinement of a student in a room or other space from which the student is physically prevented from leaving and which provides for continuous adult observation of the student.

Seclusion is the involuntary confinement of a student alone in any room or area. It includes the use of any room or area in which the student is alone and not free to leave (or believes they are not free to leave).

In December 2016, the state of Michigan adopted Public Act 394 of 2016 restricting the use of seclusion and restraint in schools. On March 14, 2017, the State Board of Education (SBE) adopted the Policy for the Emergency Use of Seclusion and Restraint as required by MCL 380.1307.

There are 4 variants to seclusion: placing a patient in a locked room; placing a patient in a room with the door held shut; placing a patient in a room in which freedom is restricted; and separation of a patient from the group.
