1 What is HARPTA? Under HARPTA (section 235-68, Hawaii Revised Statutes (HRS)), every buyer is required to withhold and pay to the Department of Taxation (Department) 7.25% of the amount realized on the disposition of Hawaii real property.

This law and Sections 897 and 2445 of the Internal Revenue Service Code (IRC) require withholding of the capital gains tax due when the sale closes. amount equal to ten percent (10%) of the “amount realized” on sale, which is normally 10% of the sales price.
