The Dower Right is a historic concept that still exists today in Alberta. They are a married person's rights to occupy the dwelling place or use household contents in that place which are owned in the name of their spouse.

The common law rules no longer apply in Alberta (2) but have been replaced by the Dower Act which grants dower rights to both the husband and wife and uses the term "spouse".

The Dower Act protects a spouse if the couple's home is solely owned by the other spouse. It has two features that prevent a non-owner spouse from losing their home unexpectedly: Consent to disposition: The owner cannot sell, lease, mortgage, or otherwise transfer the homestead without the non-owner's consent.

What Are Dower Rights. Today, dower rights protect the spouse of a registered owner of real property (a house on land). The Dower Act requires the spouse who is not on title to consent to any disposition of land. A disposition of land usually comes up as the sale or mortgaging of the property.

Under the Dower Act, neither spouse may sell or mortgage the home without the other's written consent. These rights do not exist before you marry, if you are common-law, or when you are divorced. You have Dower rights if you are presently separated from your spouse but not yet divorced.

The MPA describes matrimonial property as that which was acquired by either spouse, or jointly, during the marriage or after separation. Matrimonial property, which also includes debts, will be divided equally between the divorcing spouses unless special circumstances make an equal division unfair.
