An NPS must be certified by the Depart- ment of Education and meet certain stan- dards set by the Superintendent and Board of Education.

Accreditation, Registration, Licensing, and Recognition. Nonpublic schools in Illinois may register with the Illinois State Board of Education (ISBE) on an annual basis.

1. Nonpublic Agencies & Schools. Local educational agencies (“LEAs”) throughout the state utilize non-public schools (“NPS”) and non-public agencies (“NPA”) to provide educational placements and services to students who receive special education services.

The International Covenant on Economic, Social and Cultural Rights requires, within a reasonable number of years, the principle of compulsory education free of charge for all. All countries except Bhutan, Papua New Guinea, Solomon Islands, and Vatican City have compulsory education.

Private schools do not receive funding and are not required to provide a free appropriate education or an IEP. They are not required to provide any special education services to children with disabilities. However, private schools are bound by Section 504 – the civil rights law.

LRE requires that, to the maximum extent appropriate, students with disabilities aged 3 through 21, in public or private institutions or other care facilities, are educated with children who are not disabled [34 C.F.R. §300.550 (b)(1)].
