What is a Probate Estate? A probate estate is a legal proceeding provided for by Ohio law to determine the assets of a deceased person who was an Ohio resident at the time of death, the value of those assets, and the distribution of those assets to the persons entitled to them by law.

What Qualifies As A Small Estate In Ohio? An Ohio estate qualifies as a small estate if the value of the probate estate is: $35,000 or less; OR. $100,000 or less and the entire estate goes to the decedent's surviving spouse whether under a valid will or under intestacy.

The total value of the decedent's assets must be under $35,000 to qualify as a small estate. The limit is raised to $100,000 for surviving spouses if one of the following applies: The decedent left a will entitling the spouse to all of the decedent's assets (§ 2113.03(A)(2)(a)).

If there is no spouse and no children, the deceased's parents will inherit. More distant relatives—aunts, nephews, cousins of any degree, etc. —are next in line if the deceased had no spouse, children, or parents. If the court cannot locate any living relatives, the state of Ohio will inherit the entire estate.

In most cases, probate is required in Ohio. While there are a few exceptions, most estates will go through the probate process. It can be a simple process or a more complicated situation, which can take more time and require the assistance of an attorney.

In Ohio, executor fees are calculated primarily as a percentage of the estate's assets (other than real estate) and any income generated by the estate: 4.0% on the first $100K. 3.0% on the next $300K. 2.0% on anything more.

Relief from administration can only be used for estates that are valued at $35,000 or less, or up to $100,000 when the applicant is the decdent's surviving spouse.

No probate at all is necessary if the estate is worth less than $5,000 or the amount of the funeral expenses, whichever is less. In that case, anyone (except the surviving spouse) who has paid or is obligated to pay those expenses may ask the court for a summary release from administration.
