Capacity means the role of the signatory (for example an attorney or a director of a company). Client means the person or persons named in this Client Authorisation. Client Agent means a person authorised to act as the Client's agent but does not include the Representative acting solely in this role.

An Authority to Act Form allows you to appoint someone to act on your behalf, and should set out the roles and responsibilities of the agent and principal. It should also clarify any ambiguity around the scope or purpose of the action required.

A Client Authorisation is required whenever a lawyer or conveyancer represents a client in a transaction in an electronic lodgment network, except where the lawyer. or conveyancer is preparing and lodging a caveat or, in those jurisdictions that have them, a priority notice.

To ensure the process is secure and there are no fraudulent signatures, to lodge documents via PEXA a Client Authorisation Form (“CAF”) is required and a Verification of Identity (“VOI”) process must be undertaken.

A Client Authorisation is a Document that enables a Party to a transaction (the Client) to authorise a conveyancer or lawyer to act on their behalf in that transaction.

The Client Authorisation ends upon the death of the Client, except in the case of South Australia (see section 59 of the Real Property Act 1886 (SA)).
