It may decide to pay the death benefit to your estate, or it may use its discretion to decide which of your eligible beneficiaries receives the death benefit.

What is a Binding death benefit nomination? A binding death benefit nomination is a legal document which binds Brighter Super to pay your benefit to your nominated beneficiary or beneficiaries provided it is still a valid nomination at the time of your death.

There are two types of death benefit nominations: binding and non-binding. Both are only activated on the superannuation members' death and are usually paid in lump sums to the beneficiaries.

Who can be my beneficiary? your spouse or partner. your children. anybody financially dependent on you when you die. your estate or legal representative – known as an executor.

If you don't make a written death benefit nomination, the trustee of your super fund will decide who receives your death benefit. It may decide to pay the death benefit to your estate, or it may use its discretion to decide which of your eligible beneficiaries receives the death benefit.

You may need to decide whether you want a binding nomination to be lapsing or non-lapsing. A lapsing nomination must be renewed after a certain period (typically every three years), whereas a non-lapsing nomination is permanent unless you change or review it.

What does it mean? A non-binding or preferred beneficiary nomination will guide the Trustee of the Fund as to your wishes; however, the Trustee makes the final decision as to whom the benefit will be paid. The Trustee is guided by superannuation legislation and must ensure the benefit is paid to your dependants.
