Small Claims Court in Ontario will hear claims for money or personal property at a value of $35,000 or less (not including interest or costs). If you are looking to sue for an amount higher than $35,000 you will need to file your claim with the Superior Court of Justice and follow the civil litigation process instead.

A trial may take less than one day, multiple days or weeks, depending on multiple factors such as the complexity of the issues, the amount of evidence to be presented by the parties and the availability of counsel and court schedules.

File both the original defence (with any supporting documents and affidavit(s) of service) and a copy for yourself and each defendant, with the court in person or by mail, or file the defence and documents online using the Small Claims Court Submissions Online portal at .ontario.ca/page/file-small-claims-online .

To start your financial disclosure, you will need to complete either: Form 13: Financial Statement (Support Claims) if your case involves child support or spousal support, but not property issues.

Form 13A – List of Proposed Witnesses: If one or more Defendant's have filed a Defence then the matter will proceed to a Settlement Conference. At least 14 days before the hearing the parties are supposed to exchange any documents they intend to rely upon and provide a List of Proposed Witnesses.

The Small Claims Court hears civil claims for $35,000 or less. The streamlined procedures in the Rules of the Small Claims Court allow the Court to determine cases more quickly and at a lower cost than in the Superior Court of Justice. Typically, deputy judges preside in Small Claims Court proceedings.

Use clear, simple language when writing your story. Give enough details that the judge can understand what has happened, but not so many that they will become impatient, bored or confused while reading your affidavit. Find someone who is authorized to commission your signature on your affidavit.

What does it cost to file a Small Claim? Filing a claim will cost between $100 to $215. Other steps in the process, such as setting a trial date or requesting a default judgment, can cost between $89 and $320. In some cases, filing fees can be waived if you cannot afford them and make a request for a fee waiver.
