Section 11A of the Restraining Orders Act 1997 states that the Court may grant a VRO if the respondent has committed an act of abuse against you, and unless restrained, is likely again to commit such an act, or you reasonably fear that the respondent is likely to commit an act of abuse against you.

The most common reason for restraining orders is when an abuser violates domestic violence laws. This can include harassment, assault, terroristic threats, burglary, lewdness, criminal trespass, stalking, kidnapping, criminal mischief, false imprisonment, or sexual assault.

To obtain this type of order, you will need to ask the court clerk for forms to formally request it. If this is an emergency (again, if you are in immediate harm call 911), a temporary order, valid for 14 days, will be issued. And it must be served on the offending person in order to be valid.

In a family law case, you can ask the court for a domestic violence Order for Protection or an Order for Protection - Unlawful Harassment. For immediate protection, contact the clerk of the court for more information. You can ask the court for a Restraining Order.

There is no fee for applying to the Magistrates Court for a violence restraining order.

Family Violence Restraining Orders An FVRO can be obtained against a partner, ex-partner or another family member, such as a brother, sister or grandparent. You can apply for an FVRO at any Magistrates Court by filling in and filing a simple form.

If you want a VRO against someone under 18 years old, you must apply in the Children's Court. If the application is to protect someone under 18 years old and is against someone older than 18 years old, you can apply in the Children's Court or the Magistrates Court.

The county prosecutor or attorney general, when involved in paternity actions, may request a restraining order on behalf of the child. WHAT IS THE COST? Filing fee is $110.00 (plus possible local surcharge) but may be waived. Additional costs can include copy, service and attorneys fees.
