Ottenere il CDU è obbligatorio per gli atti di passaggio di proprietà o di cessione di diritti di terreni censiti al Catasto Terreni o aree urbane di pertinenza a fabbricati censite al Catasto Urbano, con superficie maggiore od uguale a mq. 5.000.

Il certificato di destinazione urbanistica deve essere richiesto al Comune dal proprietario del terreno, e le relative spese sono a suo carico. Il certificato di destinazione urbanistica ha validità per un anno dal suo rilascio, a condizione che nel frattempo non siano intervenute modifiche agli strumenti urbanistici.
