Yes. The total amount that an employer can deduct from an employee's paycheck is one-half (50%) of the employee's net disposable earnings.

The state places no cap on the amount of child support a paying parent must pay each month. Instead, it's based solely on the amount of income both parents make each month, the amount the greater-earning parent earns, and the parenting/custody time of each parent.

You must withhold the required amount as long as the amount does not exceed 50% of the employee's net disposable earnings. An Order/Notice for child support has priority against any attachment, execution or other assignment.

Generally, we will call the employer and request that the support be deducted from the employee's paycheck and sent to the State Disbursement Unit , as directed by the Income Withholding Order/Notice for Support ( IWO ). If the employer fails to deduct and remit the support, we will send the employer a written request.

A: The new 2024 California child support law requires the CA family court to consider a number of additional factors regarding employment history and earnings potential, among other things, to determine the monthly amount a parent will be required to pay in child support.
