An itemized list of the estate's assets. Any funds or property received by the estate during its administration. All expenses paid by the estate, including payment to the Executor, funeral expenses, taxes, debts, etc. Any distributions to beneficiaries, already made and planned.

Anyone in Massachusetts who wants to challenge either a will or the person nominated in the will to serve as executor of the estate is required to file with the court a document known as an “affidavit of objections” that is signed under the pains and penalties of perjury.

Is there a deadline to probate an estate? The general rule is that an estate has to be probated within 3 years of when the decedent died.

Massachusetts does not have what's known as an Affidavit procedure for small estates, but they do have a summary probate procedure. An estate value must be less than $25,000 and have no real property to qualify.

Within 30 days of the deadline to file an appearance, you must then file what is known as an “affidavit of objections”. This is a statement under oath by which you must set forth facts forming basis of your claim of undue influence.

In person. You can submit the forms and fees in person at the correct Probate & Family Court. If the decedent lived in Massachusetts — File in the county where they lived when they died. If the decedent didn't live in Massachusetts — File in any county where the decedent had property when they died.

The deceased commonly leave behind debts that creditors will undoubtedly want to be paid. Massachusetts law gives unsecured creditors one year after the debtor's death to make a claim against the estate. For this reason, any probated estate must remain open for one year.

The probate process can take about 12-18 months. Per Massachusetts law, “an estate must be probated within three years.” Many factors can delay the probate process. As a Massachusetts probate lawyer, I can help work to avoid the delays and ensure that any complications that occur are resolved quickly.
