(a) Under section 449 of the act (77 P. S. § 1000.5), upon or after filing a petition, the parties may engage in a compromise and release of any and all liability which is claimed to exist under the act on account of injury or death, subject to approval by the judge after consideration at a hearing.

A compromise and release is an agreement for the insurance company to issue you a lump sum payment to settle the entire workers' compensation case. The value of the settlement is determined mainly by your present (and projected future) lost wages and medical care expenses.

Workers Compensation cases can sometimes settle shortly after an injury (within a few weeks or a couple of months), or they can take years. The average workers' compensation case will take about 16 months to be resolved. A resolution may result in a settlement agreement or a hearing with a judge.

A 'compromise and release' agreement is one resolution to a permanent disability workers' compensation case. The agreement is a formal contract between the injured worker and the paying party to settle a lump sum payment claim.

Pennsylvania compromise and release agreements specifically allow the release of both indemnity and medical benefits. This means that in exchange for some form of compensation, an injured worker agrees to never request more money to cover their medical or other expenses arising from the underlying injury.
