Section 58 (5) of the Condo Act says owners can requisition a meeting to repeal a rule.

In particular, some might point to section 55 of the Act, which both entitles a unit owner, purchaser or mortgagee (or agent) to make a request to examine records of the corporation and sets out restrictions on what records may be requested.

A substantial change is: a change where the total estimated cost is greater than 10% of the annual budgeted common expenses for the current fiscal year; or • a change that the Board elects to treat as substantial (this is less common).

Management and directors are expected to adhere to whatever bylaws are in place for your condo corporation. There is no flexibility in choosing to ignore bylaws or to reinterpret them. Changing bylaws requires a quorum of directors AND support from over 50% of unit owners.

A Section 98 Agreement, also known as an “indemnity agreement” or an “alteration agreement”, is required in all situations where a unit owner proposes to make an addition, alteration or improvement (collectively, the “Improvement”) to the common elements of a condominium.

Section 83(1) of the Act requires landlords to notify the condo corporation of the rental and provide a copy of the lease within 10 days of signing.
