Part (d)(2) states that even if your aircraft is not required to have a MEL, the inoperative piece of equipment must not be required by the manufacturer to be serviceable, as indicated in the POH. This effectively means that if the aircraft has an MMEL, the MMEL must be followed, even if a MEL is not legally required.

The MEL is similar to the MMEL. Their difference is that the MEL is formulated for a particular operator and a certain aircraft or a few aircraft, whereas the MMEL is formulated for all aircrafts of this type.

Master Minimum Equipment List (MMEL): A master list of items on an aircraft that are allowed to be inoperative under specific conditions without impacting the safety of flight. The MMEL is established by the aircraft manufacturer and approved by the national aviation authority.

Some operators of aircraft, based on the kind of operation or size and type of aircraft are required to have a Minimum Equipment List (MEL) in order to operate the aircraft with inoperative instruments or equipment.
