In Illinois, court-annexed arbitration is a mandatory, non-binding, non-court procedure designed to resolve civil disputes by utilizing a neutral third party, called an arbitration panel.

The goal of the Mandatory Arbitration Program is to provide litigants who have a civil case, other than an appeal from a court of limited jurisdiction, a simplified and economical procedure for obtaining the prompt and equitable resolution of disputes that have been filed in Superior Court.

(a) The final decision of the arbitrator may be appealed by filing a notice of appeal with the superior court requesting a trial de novo on all issues of law and fact. The notice of appeal must be filed within thirty days after the date on which the decision was served on the party filing the notice of appeal.

Want to serve as an arbitrator? Pursuant to RCW 7.06. 040, an arbitrator must be a member of the state bar association who has been admitted to the bar for a minimum of five years or who is a retired judge. They must have a minimum of 15% of their practice in any area where a case would be assigned.

Mandatory arbitration is available in most counties in Washington State for cases with a total value of less than $100,000.00 or when the plaintiff waives any claim above $100,000.00.

In Washington, an arbitrator must be a licensed attorney with at least 5 years of experience practicing law or another individual who has undergone special training (RCW 11.96A. 310). After the hearing the arbitrator provides a written decision or award within 14 days of the hearing. The award is filed with the court.
