700.5217 Termination of appointment of guardian. Sec. 5217. A guardian's authority and responsibility terminate upon the guardian's death, resignation, or removal or upon the minor's death, adoption, marriage, or attainment of majority.

A guardianship can provide necessary care for an individual. However, it can also be oppressive when no longer needed. Termination of guardianship can be just as difficult as establishing one. It requires court hearings and involvement by legal professionals who will be fighting for competing sides.

The parent or parents can withdraw their consent or petition to terminate the limited guardianship at any time by filing the necessary documents. In this situation, the court must discharge the guardianship, but may require a hearing before doing so.

A guardian may request court approval of the guardian's resignation by submitting a petition and filing a report with the court. On approval of the report and acceptance of the resignation, the court has authority to make other appropriate orders, including termination of the guardianship.

A full guardianship may continue until the minor turns 18; the guardian must file annual reports with the court regarding the child's well-being, and notify the court of any change in the child's address within 14 days of the move.

Having a guardian does not generally change this. After a guardian is appointed, the parent may continue to have custody. Even when the parent does not have custody, they may have a court order that allows them to visit their child. In some circumstances, a court may suspend or terminate a parent's rights.

The Guardian must file a Petition for Discharge with a copy of the Ward's Death Certificate. The court will terminate the Guardianship of the Person immediately upon the filing of the Petition. However, the Guardian of the Property must file additional documentation before being discharged.

If the guardians agree with you that the guardianship can be ended, you and the guardians can prepare and sign a written statement ending the guardianship and giving the child back to you. You must give the agreement to the guardianship court for approval before the guardianship can be ended.
