In West Virginia, the Uniform Power of Attorney Act says that you can execute one form regarding decision-making about your property, including your money, investments, taxes, trusts, and real estate. When you make a general of power of attorney, you call the shots: You decide when it takes effect.

A general power of attorney allows the agent to make a wide range of decisions. This is your best option if you want to maximize the person's freedom to handle your assets and manage your care.

The law now allows the Principal to select a person to appoint additional Successor Agents. For instance, if the Agent is your spouse and the Successor Agent is your daughter, you can give someone power to appoint another Successor Agent to act if your spouse and daughter both die, resign or become incapacitated.

This power of attorney authorizes another person (your agent) to make decisions concerning your property for you (the principal). Your agent will be able to make decisions and act with respect to your property (including your money) whether or not you are able to act for yourself.

Texas's statutory form of durable power of attorney is found in Section 752.051 of the Texas Estates Code. It is a financial durable power of attorney - this means that it only allows the agent to handle financial matters. It does not permit the agent to make decisions about the principal's health care.

One of the biggest changes with the new form is that it requires the person signing (the “principal”) the power of attorney to initial the powers he or she wishes to grant to the agent. Presently, the principal simply crosses out the specific powers the principal does not wish to give the agent.
