There is no “legal separation” in South Carolina. You are still married to your spouse until the judge signs your divorce decree. On the same note, you are still married, so until you are divorced you cannot marry another person as it would constitute bigamy.

SC does not require a “legal separation” before you can get your final divorce decree, although you may be required to live separate and apart for one year if it is a no-fault divorce. An Order for Separate Maintenance and Support is not required for you to get your divorce.

In South Carolina, the courts merely base the amount of alimony on the length of the marriage. Usually, for every three years of marriage, the dependent spouse receives one year of alimony. These payments may be discontinued if the receiving spouse remarries or cohabitates with another person.

In Michigan, this legal action is called “separate maintenance.” This is a court case between a married couple that can divide property and debt, decide child support, custody, and parenting time, and award spousal support. It is almost the same as divorce, except at the end of the case the couple stays married.

A "separate maintenance" case addresses all the same issues involved in a divorce, except the parties do not actually get divorced. At the end of the case, the parties will have final custody orders, support orders, and property and debts will be divided. However, the parties will still be legally married.

An Order of Separate Maintenance and Support is a temporary order; it does not cover the issue of divorce, and it does not end the parties' marriage. In South Carolina, the only way to obtain a no-fault divorce is to live separately for one year. Living separately occurs when spouses live in two different locations.
