Secured party means a lender, seller, or other person in whose favor there is a security interest under applicable law.

There are several types of creditors, such as real creditors, personal creditors, secured creditors and unsecured creditors.

A creditor can be a person or financial institution—like a bank or credit card issuer—that offers credit to another party. The party that borrows the credit is called a debtor.

What duties do creditors have? The most important duty of creditors is to protect their own interests. At least once a year, creditors should check that companies are able to pay for the goods and services they receive.

In order to become a secured party, one must (i) prepare a document which grants a security interest (which is the agreement between the parties) and (ii) also perfect on that security interest (which is the notice to the world of the security interest). Without both steps occurring, the lender will be unsecured.

Steps to Take to Become a Secured Creditor Prepare a security agreement with your customer. File a UCC-1 form or financing statement with the appropriate state office. Search for and notify other secured creditors that you have "perfected" or established priority.

Secured Creditors are creditors that hold a lien on its debtor's property, whether that property is real property or personal property. The lien gives the secured creditor an interest in its debtor's property that provides for the property to be sold to satisfy the debt in cases of default.
