Because the smaller states feared the domination of the larger ones, each state had one vote in the Confederation Congress, regardless of its size or population. Any act of Congress required the votes of nine of the thirteen states to pass.

Ratification. The process set out in the Constitution for its ratification provided for much popular debate in the States. The Constitution would take effect once it had been ratified by nine of the thirteen State legislatures; unanimity was not required.

I, Sec. 2, Cl. 3), the Framers believed that any combination of nine states would comprise a majority of American citizens. Even if the five most populous states all refused to ratify, the remaining nine still would represent a majority of the electorate.

Patrick Henry refused to attend the Constitutional Convention. These concerns notwithstanding, every state except Rhode Island sent delegates. Fifty-five men in all would participate in the Convention, including George Washington of Virginia, Alexander Hamilton of New York, and Benjamin Franklin of Pennsylvania.

Congress needed 9 of 13 states to pass any laws. Requiring this high supermajority made it very difficult to pass any legislation that would affect all 13 states.

Nine states needed to vote for the Constitution for it to be accepted. Each state was given six months to meet and vote on the proposed Constitution. On December 7, 1787, Delaware was the first state to vote in favor of, or ratify, it.

To encourage delegates to make arguments without fear of recrimination and to discourage mob action in the city, those in attendance kept their deliberations secret during their lifetimes and did not inform the public of the resulting document until September 17, after most of the delegates had signed on to it.
