For example, if a Hindu male dies intestate leaving behind his widow, two sons, son of a predeceased son, widow of another predeceased son, two daughters and son of a predeceased daughter, all of them will inherit simultaneously because all of them are heirs in the Class I of the Schedule.

A. Property inherited by a male Hindu from his father, father's father, or father's father's father, is ancestral property. The children, grandchildren and great-grandchildren of the person inheriting such property acquire an interest in it by birth.

Intestate Succession in case of Death of a Male. In case a male dies intestate, i.e. without making a will, his assets shall be distributed ing to the Hindu Succession Act and the property is transferred to the legal heirs of the deceased.

What is the difference between the Indian Succession Act and Hindu Succession Act? The Hindu Succession Act applies to Hindus only which includes Jains, Sikhs and Buddhists. Whereas the Indian Succession Act applies to those not covered under Hindus or Muslims.

(1) Brother's son, (2) sister's son, (3) brother's daughter, (4) sister's daughter.

Under Hindu Law: the wife has a right to inherit the property of her husband only after his death if he dies intestate. Hindu Succession Act, 1956 describes legal heirs of a male dying intestate and the wife is included in the Class I heirs, and she inherits equally with other legal heirs.

So, when a Hindu male dies intestate, his property will go to Class I heirs. These include son/daughter widow; mother; son/daughter of the predeceased daughter; widow of the predeceased son; son/daughter of the predeceased son; widow of the predeceased son.

The children, both son and daughter, under the Hindu Succession Act 1956, have equal rights over the father's property to be shared with the mother and grandmother. Even a posthumously born child, if born alive, has rights to the father's property.
