Paying Taxes On The Per Diem You Receive If you receive a per diem payment that is more than the federal per diem rate, you will be required to pay income tax withholding and payroll taxes, since the excess amount will be considered wages. Your employer should report this to you on a W-2 form.

Amounts paid for per diem must always be included in the Form 1099. In summary, whatever is paid to the inde- pendent contractor, whether in the form of compensation or expense reimburse- ment, should be reported on the Form 1099–MISC.

To find per diem rates, visit .gsa.gov. Report your per diem tax amounts on Form 2106.

The report must include: • The business purpose of the trip, • The date and place of the trip, and • Receipts for lodging (if using the meals-only per diem rate). The employee must file the expense report with the employer within a reasonable period of time (60 days).
