In 2022, the California legislature passed a legislative package acting on California Governor Gavin Newsom's proposal to bring an early end to California's 2020-2022 net operating loss (NOL) deduction suspension. As a result, taxpayers may now deduct NOLs on their 2022 tax return.

Eligible small business is any business or person that meets both of the following requirements: • Had gross receipts for the preceding taxable year that did not exceed $1 million, or if gross receipts exceeded $1 million, employed no more than 30 full-time employees during the preceding taxable year.

Purpose. Use form FTB 3805P, Additional Taxes on Qualified Plans (Including IRAs) and Other Tax-Favored Accounts, to report any additional tax you may owe on an early distribution from an IRA, other qualified retirement plan, annuity, modified endowment contract, or medical savings account (MSA).

EBLs are calculated by determining the amount by which a taxpayer's aggregate trade or business deductions or losses exceed their gross trade or business income or gain. The ability to deduct the losses, to the extent they exceed income, is limited to an annual threshold amount indexed for inflation.

If your deductions and losses are greater than your income from all sources in a tax year, you may have a net operating loss (NOL). You may be able to claim your loss as an NOL deduction. This deduction can be carried back to the past 2 years and/or you can carry it forward to future tax years.
