On July 1st, 2020, the U.S-Mexico-Canada Agreement (USMCA), Canada-U.S. Mexico Agreement (CUSMA), and Tratado entre Mexico, Estados Unidos y Canada (T-MEC) will enter into force and replace the current North American Free Trade Agreement (NAFTA).

A good example of a Free Trade Agreement is the North American Free Trade Agreement (NAFTA). NAFTA was signed among 3 countries – the United States of America, Mexico, and Canada.

What is the NAFTA Certificate of Origin? The NAFTA Certificate of Origin is used by the United States, Canada, and Mexico to determine if imported goods are eligible to receive reduced or eliminated duty as specified by the NAFTA.

CBP Form 434, North American Free Trade Agreement Certificate of Origin, is used to certify that a good being exported either from the United States into Canada or Mexico or from Canada or Mexico into the United States qualifies as an originating good for purposes of preferential tariff treatment under NAFTA.

Perot opposed NAFTA, stating that the policy would harm American workers (as the presumption was that American companies would outsource their labor to Mexico as soon as the agreement was put into effect);

The North American Free Trade Agreement (NAFTA), which was enacted in 1994 and created a free trade zone for Mexico, Canada, and the United States, is the most important feature in the U.S.-Mexico bilateral commercial relationship.

The NAFTA Certificate of Origin is only needed for shipments to another NAFTA country to qualify for preferential tariff treatment under the NAFTA rules of origin. A certificate is not needed if the shipment does not qualify for preferential treatment, or if a NAFTA claim will not be made on the imported goods.

This is a trilaterally agreed upon form used by Canada, Mexico, and the United States to certify that goods qualify for the preferential tariff treatment ed by NAFTA. The Certificate of Origin must be completed by the exporter.
