Unemployment taxes are not deducted from employee wages. Most employers are required to pay Unemployment Insurance ( UI ) tax under certain circumstances. The Texas Workforce Commission uses three employment categories: regular, domestic and agricultural. Employer tax liability differs for each type of employment.

After you have been unemployed for eight weeks, you must be willing to accept a suitable job that pays at least 75 percent of your normal wage. If you do not apply for suitable work, accept suitable work, or return to your regular self-employment work, TWC may disqualify you for benefits.

If we do not receive a response within the 14-day deadline, you are not an interested party to the claim. This means you do not receive a determination on the claim and you do not have the right to appeal the determination.

How to Stop Your Claim. To stop your claim: After your first week of full-time work, stop requesting payments. Once you have returned to full-time work, you are no longer eligible for unemployment benefits, even if you have a balance remaining on your claim.

The bad news is that if you lose the appeal or do not appeal within the allotted time, then you will owe money to the TWC. This could cause you to likely pay back most, if not all, the benefits that were paid out to you as unemployment.

The overpayment stays on your claim record until you repay it in full. If you apply for benefits, TWC will apply each eligible payment toward reducing your overpayment until the overpayment is repaid. The Texas State Comptroller can recover your overpayment by withholding certain payments to you.

Texas tried to get money back from 1.5 million people between 2020 and 2021, and half a million Texans have appealed. The state also tried to seize the federal tax returns of 31,000 residents. Texas isn't the only state being sued over its practices. Rhode Island, Michigan and Maryland have also been sued.
