OSHA has much broader authority than MSHA. While MSHA is responsible solely for the mining industry, OSHA has jurisdiction over most private sector employers and employees as well as some public sector employees.

Part 50 of Title 30 of the Code of Federal Regulation (30 CFR Part 50) requires mine operators to immediately notify MSHA of accidents, requires operators to investigate accidents, and restricts disturbance of accident related areas.

There are two types of training requirements in 30 CFR, Part 46 and Part 48. Part 48 covers all underground mines, surface coal mines, and some surface metal/nonmetal mines. Part 46 on the other hand covers very specific types of mines. NOTE: If you are a contractor at a Part 46 mine you may also be under Part 48.

MSHA Part 46 Training Part 46 certification must be renewed every year with an 8 hour Annual Refresher training. There is a small amount of wiggle room. The training does not expire after exactly 365 days. You are compliant until the end of the calendar month one year after your last Annual Refresher training.
