In Texas, anyone who wants to use surface water must first get permission from the state, unless they are using the water for one of several “exempt uses” in the Texas Water Code.

Texas landowners actually have three types of rights under the Rule of Capture. One is the right to try to capture groundwater, the second is the right to the water actually brought to the surface and captured and the third is the right to use or sell this water. All three rights can be sold, or leased to others.

What is GWUDI? GWUDI is an anacronym for “ground water under direct influence” of surface water. This means that the groundwater source (i.e. well, spring, mine, etc.) is located close enough to nearby surface water to receive direct surface water recharge.
