How much will a former spouse receive under the USFSPA? The maximum amount that can be paid under the USFSPA is 50 percent of the member's disposable income. DFAS will pay a former spouse the monthly amount or amounts awarded in the pertinent court order up to the 50% limit.

A state court can divide retired pay in any way it chooses (subject to the laws of that state). All 50 states treat military pension as marital or community property. One of the popular misconceptions about military retired pay is that it is only divisible if the marriage lasted at least 10 years.

How Long Does a Military Spouse Receive Pay After Divorce? If your former spouse is entitled to a portion of your military retirement pay, then they will continue to receive this payment until one of you passes away. If you die before your ex, then their benefits will stop.

Many military members wonder: Can my ex-spouse claim a part of this pension after divorce? Federal laws do not entitle former spouses to a member's military retired pay. For your ex to collect part of your military pension after divorce, the award must have been part of your settlement.

Procedure for request for direct pay Signed DD Form 2293, “Application for Former Spouse Payments from Retired Pay” A copy of the court order. Other accompanying documents that provide for payment of child support, alimony or division of property, certified by an official of the issuing court within the previous 90 days.

To qualify for direct payment, the USFSPA requires that a former spouse must have been married to the member during at least 10 years of the member's service creditable for retired pay. Under the USFSPA no more than 50 percent of a member's disposable retired pay will be sent as a direct payment.

To determine the community property portion of military retired pay, take the marital pension service and divide it by the total pension service as of the divorce date. Multiply the disposable retired pay by this community fraction.

First, we calculate the marital share as a percentage - that is 5 years of marriage divided by 6 years of service, or 83.33%. (Normally the calculation is more granular than this, and done by months, or even days).
