The Massachusetts businesses who buy and sell exempt products (Materials, Tools, Fuels, and Machinery) used in manufacturing are the direct beneficiaries of the sales tax exemption.

A corporation…is a section 38 manufacturer for any taxable year if (i) it is engaged in manufacturing during the taxable year and (ii) its manufacturing activity during the taxable year is substantial.

The industrial machinery and equipment sector is Massachusetts' largest in terms of employment, accounting for 15% of the state's industrial workforce. This is followed by the electronic and other electrical equipment industry as well as instruments and related products, each accounting for 13%.

A corporation classified as a manufacturing corporation by the Department is entitled to an exemption of all its machinery from local property tax. See 830 CMR 58.2. 1(4). The exemption applies whether or not the machinery is used directly in manufacturing.

In order for a purchase to be exempt from Massachusetts tax, an authorized federal employee must present to the vendor the GSA card with appropriate identification at the time of purchase. A Certificate of Exemption (Form ST-2) and a Sales Tax Exempt Purchaser Certificate (Form ST-5) are not required.
