Under California law, the lender can require an impound account for a single-family, owner-occupied dwelling if: a state or federal regulatory authority requires the account. the loan is made, guaranteed, or insured by a state or federal governmental lending or insuring agency (like FHA or VA)

For California loans, your lender will require you to open an escrow account if your loan-to-value (LTV) is greater than 90% or if the loan is insured by FHA (Federal Housing Administration) or the VA (Veteran's Administration). LTV is the relationship between loan balance and property value.

In California, impounds are only required if the loan-to-value ratio (LTV) is 90% or higher.

An escrow account, sometimes called an impound account depending on where you live, is set up by your mortgage lender to pay certain property-related expenses. The money that goes into the account comes from a portion of your monthly mortgage payment.

California real estate law doesn't require you use escrow, but it does have escrow laws. The state licenses escrow agents, though banks and title insurance companies can provide escrow services without a license.

California is among seventeen states that require a lender to pay interest on a mortgage loan's impound or escrow account. ¹ California's interest on impound account law covers money received in advance for payment of taxes, insurance or other purposes relating to the property.

Civil Code Section 2954.8(a) requires a lender "that receives money in advance for payment of taxes and assessments on the property, for insurance, or for other purposes relating to the property" to pay two percent interest per annum on the amount being held.
