If you are claiming a refund on behalf of a deceased taxpayer, you must file Form 1310 if: You are NOT a surviving spouse filing an original or amended joint return with the decedent; and You are NOT a personal representative (defined later) filing, for the decedent, an original Form 1040, 1040-SR, 1040A, 1040EZ, ...

The legal representative is the person responsible for filing a tax return for the deceased. In most cases, this is the executor of the will, as Brougham states. The court appoints an administrator often a spouse or next of kin when the will does not name an executor or there is no will at all.

The legal representative of the deceased must report all of the deceased's income from January 1 of the year of death up to and including the date of death, and report income earned after the date of death on a T3 Trust Income Tax and Information Return. The legal representative of the deceased must sign the return.

If Form 1310 is present, and either check box "A" or "B" is marked, then the form and the return must be paper-filed. RETURN MUST BE PAPER-FILED: If there is an entry in either box "A" or "B" on screen 1310, the return is not eligible for e-file. This return must be paper-filed.

If you can't pay the amount due immediately, you may qualify for a payment plan or installment agreement. If the decedent is due a refund of any individual income tax (Form 1040), you may claim that refund using IRS Form 1310, Statement of a Person Claiming Refund Due a Deceased Taxpayer.

Can Form 1310 Be E-Filed? Depending on the circumstances, a return that includes Form 1310 may or may not be filed electronically. Answer the questions in the Form 1310 Menu appropriately, based on the decedent's situation.

Can a tax return for a deceased taxpayer be e-filed? Yes, it can. Whether e-filed or filed on paper, be sure to write deceased after the taxpayer's name. If paper filed, also include the taxpayer's date of death across the top of the return.

You can return the joint-name check with Form 1310 to your local IRS office or the Internal Revenue Service Center where you filed your return.
